Construction law update - Thursday 8 October 2009

Our construction team held their latest update session on Thursday 8 October at our offices in the centre of Birmingham.

The team covered a number of recent developments in construction law including:

Recent changes to JCT contracts. JCT have published Revision 2 of their contracts which includes wholesale amendments and alterations to the terms. Keith Blizzard, a director in our construction team, highlighted the significant changes to be aware of.

The new Construction Act. The Local Democracy, Economic Development and Construction Act 2009 became law in November although it has not yet been brought into force. Ian Yule, who joined the team as a partner in May this year, examined the new regime with particular emphasis on payment notices.

New options for funding disputes. Mark English, partner and head of the construction team, looked at alternative fee structures in comparison with traditional billing and in particular discussed whether no win/no fee can work in construction claims.
