The battle of forms - what do you have to do to win?
Ian Yule, partner will review recent cases such as Pablo Star v Emirates Integrated Telecommunications (2009). Is it essential to have the last word? What about onerous terms buried away in the small print? What happens where there is a conflict between a JCT contract and amendments?
Instructing the professional
Rachael Hobbis, solicitor will deal with key issues for the architect/engineer/surveyor and also the instructing employer, with particular reference to the standard forms of appointment. How important are issues such as caps on liability, net contribution clauses and copyright? What areas can be the subject of compromise? What is 'market-standard'?
Adjudication – is it working?
Keith Blizzard, director and experienced adjudicator will review comments from the High Court in cases such as JPA Design Build v Sentosa (2009) and Enterprise Managed Services Ltd v Tony McFadden (2009). Are some cases really too complex to be adjudicated? What do the courts say about parties who use adjudication for tactical purposes?
Registration starts at 4.30pm with the presentations starting at 5pm. Drinks and nibbles will be served afterwards and the event is expected to close at 7pm.
